Vacav Terms and Conditions

Welcome to Vacav, a service designed to provide secure rides for children. By accessing or using our platform, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms herein, you may not use the service.

1. OVERVIEW

This website and mobile application (the "Service") are operated by Vacav Inc. Throughout the Terms and Conditions, the terms “we”, “us” and “our” refer to Vacav Inc. Vacav Inc. offers this Service, including all information, tools, and services available from this platform, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein.

By accessing or using any part of the Service, or by purchasing services from us, you agree to be bound by these Terms and Conditions ("Terms"). These Terms apply to all users of the Service, including but not limited to browsers, customers, drivers, and contributors of content.

If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Any new features or tools added to the current platform shall also be subject to these Terms. We reserve the right to update or modify any part of these Terms at any time by posting updates to the App or website. Continued use of the Service following any changes constitutes acceptance of those changes.

Only a parent or legal guardian may register an account and request rides on behalf of a minor. Minors are not permitted to create accounts.

Drivers must be pre-approved by Vacav and pass required screening procedures, including Trustline background checks, vehicle inspections, and proof of valid driver licensing.

Guardians must provide informed consent and confirm ride details prior to each trip.

4. PARENTAL RESPONSIBILITY & CONSENT

By registering, guardians authorize their child to use the Vacav platform and accept full responsibility for their child’s use of the Service.

Guardians must ensure that the minor is present at the scheduled pickup time and location. In the event of delays or cancellations, guardians must communicate promptly via the App, email at support@vacav.com, or phone at (916) 955-2443.

5. SAFETY & BACKGROUND CHECKS

All drivers undergo:

All vehicles used must pass safety inspections prior to approval. Drivers are required to comply with all applicable traffic laws. Vacav reserves the right to suspend or terminate driver accounts for violations.

6. PAYMENT & CANCELLATION POLICY

Payments are processed through the parent or guardian’s registered account.

Cancellations made within 48 hours of the scheduled ride may incur a cancellation fee. Refunds, if applicable, are subject to the terms outlined in the Refund Policy.

7. LIABILITY & DISCLAIMERS

Vacav Inc. assumes no liability for injuries, accidents, or misconduct occurring during any ride facilitated through the Service. Guardians acknowledge and accept the inherent risks of utilizing a third-party ride service for minors and agree to hold Vacav Inc. harmless from any resulting claims.

In case of emergency, drivers are authorized to contact emergency services (911) at their discretion.

8. LIVESTREAMING & LOCATION TRACKING

As part of Vacav’s commitment to safety and transparency, the Service includes the following features:

These data streams are securely transmitted and stored in encrypted cloud infrastructure. Archived footage and data may be retained for a limited time and are subject to automated deletion policies unless required for legal, investigative, or safety purposes.

By using the Service, Guardians expressly consent to the livestreaming and tracking features described above, including the storage and review of ride footage and location data. This consent is a mandatory condition for using Vacav to transport minors.

9. PROHIBITED CONDUCT

10. DATA PRIVACY & SECURITY

Vacav is committed to protecting your privacy. Personal data, including pickup and drop-off locations, is encrypted and stored securely. We do not sell user data to third parties.

Guardians may request data deletion by contacting customer support.

11. DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration under California law. All claims must be filed within one (1) month of the incident giving rise to the claim.

12. MODIFICATIONS TO TERMS

We reserve the right to amend these Terms and Conditions at any time. Continued use of the App following any such changes constitutes your agreement to the updated terms.

By providing your phone number and using the Vacav platform, you consent to receive SMS messages from Vacav, including but not limited to ride confirmations, reminders, driver updates, and service notifications. Message frequency will vary based on ride activity and account usage.

Message and data rates may apply, depending on your mobile carrier plan. You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you may still receive transactional or emergency-related messages as permitted by law.

Vacav is not responsible for delays or failures in message delivery caused by mobile network providers or other factors beyond our control.
